General terms and conditions of business
1. Scope
The following General Terms and Conditions (GTC) in the version valid at the time of the order apply exclusively to the business relationship between CK Commerce OG and the customer. The customer agrees that in the event of use of the GTC by him, our conditions shall apply in case of doubt, even if the customer's conditions remain unchallenged. Contract fulfillment actions on our part do not constitute consent to contractual conditions that deviate from our conditions. If there are still any ambiguities in the interpretation of the contract, these must be cleared up in such a way that the content that is usually agreed in comparable cases is deemed to be agreed. The contractual conditions become part of this contract with your order.
If a customer conducts a transaction that is not part of his or her business operations, this customer acts as a consumer. These terms and conditions apply accordingly to customers who are not consumers.
The goods are dispatched in accordance with the Austrian Consumer Protection Act (KSchG).
2. Contract language
The contract content and the contract language are German.
3. Conclusion of contract
3.1.
The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Descriptions of services in catalogues and on the seller's websites do not constitute a representation or guarantee.
All offers are valid "while stocks last" unless otherwise stated for the products. Otherwise, errors remain reserved.
Our offers are non-binding. Your order represents an offer to us to conclude a purchase contract. A purchase contract is only concluded when we send the ordered product to you. No purchase contract is concluded for products from one and the same order that are not sent. The contractual partner is CK Commerce OG.
The customer agrees that invoices may also be created and sent to him electronically.
The customer can change and view the data at any time before submitting the order. Required information is marked with an asterisk (*).
3.2.
If the customer chooses to pay in advance, the contract is concluded when the bank details and payment request are provided. If the payment is not received by the seller within 7 calendar days of the order confirmation being sent, even after a further request, despite being due, the seller will withdraw from the contract, with the result that the order is no longer valid and the seller is not obliged to deliver. The order is then completed for the buyer and seller without any further consequences. The item is therefore reserved for a maximum of 7 calendar days when paying in advance.
4. Right of withdrawal, exclusion of withdrawal, withdrawal policy
4.1. Right of withdrawal
Consumers have a right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. To exercise your right of withdrawal, you must notify us (CK Commerce OG, Doppelngasse 94/9, 3400 Klosterneuburg, Austria, email: contact@sprengeraudio.com) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or email).
4.2. Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. The refund will be made as soon as we receive the goods back or you have provided proof that you have returned the goods.

4.3. Exclusion of revocation
The right of withdrawal does not apply to contracts for the delivery of goods that are manufactured according to individual wishes or that cannot be returned after delivery for hygiene reasons.
5. Prices and shipping costs
All prices on our website include the applicable statutory sales tax. The shipping costs will be communicated to the buyer during the ordering process.
6. Storage of the contract text
The contract text is saved by us and can be viewed by the customer under the link "My Account". Independently of this, CK Commerce OG sends an order confirmation to the email address provided by the customer. The general terms and conditions are available online.
7. Availability of goods
If the product ordered by the customer is permanently unavailable, no contract is concluded. The customer will be informed of this. If the product is temporarily unavailable, the customer will be notified. If delivery is delayed by more than two weeks, the customer is entitled to withdraw from the contract.
8. Delivery conditions
Delivery is made to the address provided by the customer. The delivery period begins one day after receipt of the order. Shipping takes place after receipt of payment.
9. Self-collection
No self-collection is offered.
10. Due date and retention of title
The purchase price is due before dispatch at the latest. The delivered goods remain the property of CK Commerce OG until full payment has been made.
11. Payment methods
We accept the following payment methods: credit card, PayPal, Klarna, Apple Pay and advance payment.
12. Warranty and Disclaimer
The general legal regulations apply. Claims for damages by the customer against CK Commerce OG are excluded unless there is intentional or grossly negligent fault.
13. Set-off and retention
The customer is only entitled to a right of set-off if his counterclaims have been legally established or are undisputed.
14. Data Protection
Provisions regarding data protection are contained in the privacy policy.
15. Changes to the Terms and Conditions
By continuing to use the website, the user also accepts changes to the Terms and Conditions.
16. Formal requirements
All agreements must be made in writing.
17. Place of performance
The place of performance is the business address in Klosterneuburg.
18. Applicable Law
Austrian law applies, excluding the conflict of law rules.
19. Severability Clause
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
